#### Booking Terms & Conditions / Terms of Service

**1.- Purpose and scope**

These terms govern the process for requesting, creating, and accepting quotes, as well as booking travel services offered under the trade name "Chispa Mágica" , operated by LUXE ITINERA S.L. ,which may include, depending on the case, (i) package tours, or (ii) individual travel services or combinations of individual services (for example, tickets, accommodation, transportation, activities, or other travel services), with LUXE ITINERA S.L. acting as the organizer/retailer where applicable or as an intermediary with suppliers/organizers.

**2.- Booking process**

The user can request a quote through the "Design Your Adventure" form or via the contact channels listed on the Website. Based on the information provided, a proposal/quote will be sent (in writing on a durable medium). If the user prefers or if it is recommended, a meeting (by phone or video call) can be held to go over the quote, answer questions, and tweak details. The contract is considered finalized when the user explicitly accepts the quote and, if applicable, makes the full or partial payment (deposit/down payment) as stated in the accepted proposal.

**3.- Prior information and confirmations for online bookings**

Before signing up, you'll get the full scoop on the service (features, price, taxes, key terms, and cancellation/change policies if applicable). For online sign-ups, we'll share the required heads-up info and confirm you're good to go, following info-society rules. Also, if there's a payment due, the important details will be crystal clear before you pay, in line with consumer rules for online shopping.

**4.- Price and Payments**

The final price will be the one shown in the accepted quote and will include, when applicable, taxes, fees, or identified surcharges. Payment can be made via bank transfer, payment link, or online payment gateway, as indicated. For partial payments, the amounts paid are considered a "down payment" toward the total price and will be applied to the booked trip/service. Any potential refund or non-refund of these amounts will depend on (i) the supplier's or organizer's conditions applicable to the specific product, (ii) costs already incurred and non-refundable, and (iii) applicable regulations, especially when the product is a package tour.

**5.- Right of withdrawal**

Generally speaking, for tourism service contracts with a specific date or execution period (for example, lodging, transportation, tickets, or dated leisure activities), the 14-day right of withdrawal does not apply, without prejudice to the cancellation/modification policy applicable to the specific product and any rights granted, where applicable, by consumer regulations and specific package travel regulations.

**6.- Changes and cancellations**

Modification and cancellation conditions depend on the product, the provider/organizer, and the dates; details will be provided before booking in the quote and/or specific terms. In the event of cancellation by the user, supplier/organizer costs (including non-refundable ones) and, where applicable, management fees for the intermediation/handling performed may apply, provided they were anticipated and communicated in advance.

**7.- Insurance**

Depending on the product, the user will be offered the option to purchase insurance (for example, assistance, cancellation, or other coverages). If the user does not purchase it, express rejection may be required when necessary to keep a record of the offer. Not having insurance does not eliminate the user's legal rights or force LUXE ITINERA S.L. or the provider to assume coverages typical of an insurance policy.

**8.- Traveler documentation and requirements**

The user is responsible for providing correct traveler information and having valid personal documentation (ID/passport, visas, authorizations, health requirements, or others) as well as complying with entry/exit or transit requirements. Denial of boarding or entry due to reasons attributable to the traveler may result in penalties or loss of amounts according to the provider/organizer's conditions.

**9.- Communications**

Communications regarding the budget, conditions, confirmations, and travel documentation may be made by electronic means on a durable medium (e.g., email), and it is the user's responsibility to review and retain such communications.

#### Changes and Cancellations Policy

**1.- What conditions apply to your booking**

The conditions for changes and cancellations depend on the type of product booked. In your quote and/or booking confirmation, we will indicate whether it is a package holiday or individual services/intermediation (e.g., tickets, hotel, flights, or additional services). The specific conditions of the provider or organizer (fare, deadlines, non-refundability, etc.) will always be informed before confirmation.

**2.- Provider costs and management fees of Chispa Mágica**

Regarding changes or cancellations, there may be, on one hand, supplier/organizer/wholesaler fees or penalties (according to their terms) and, on the other hand, management fees from Chispa Mágica for administrative processing. Management fees apply when the booking has already been confirmed and processing has begun (e.g., ticketing, supplier requests, modifications, cancellations, communications, and support).

**3.- Changes (booking modification)**

If the booking allows for changes, the traveler will cover any modification fees charged by the supplier (if any) and, additionally, Chispa Mágica's management fees. For flight modifications, the management fees will be €20 per person. For modifications to other products or files, the management fees will be €15 per booking. Changes are always subject to availability and the supplier's or organizer's approval.

**4.- Cancellations - Standalone services / intermediation**

For individual service bookings, cancellation and refund conditions are mainly determined by the provider (e.g., non-refundable rates, deadlines, and penalties). Where applicable, Magic Spark's processing fees for cancellation will also apply, as per section 6. If a service is non-refundable or the provider applies a 100% penalty, there will be refund from the provider, without prejudice to the prior information that will be provided before confirmation.

**5.- Cancellations - Combined trip**

For package holidays, the traveler can cancel before the trip starts. In that case, non-refundable costs and applicable penalties may apply according to the organizer's/provider's terms, plus Magic Spark's management fees, as outlined in section 6. The total penalty for package holidays must be fair and justifiable, and upon the traveler's request, the corresponding justification will be provided.

Without prejudice to the above, in cases legally provided for package holidays, special cancellation and refund rules may apply when unavoidable and extraordinary circumstances significantly affect the trip or transport to the destination. In such cases, actions will be taken in accordance with current regulations and the pre-contractual and contractual documents provided to the traveler for the specific product.

**6.- Cancellation management fees (Magic Spark)**   
In addition to any cancellation fees charged by the supplier or organizer (if applicable), Magic Spark will charge a handling fee for processing the cancellation. For flight booking cancellations, an additional fee will be charged based on the total amount of the file: if the total amount is €500 or less, €15 per person; if the total amount is greater than €500 and up to €1,000, €25 per person; if the total amount is greater than €1,000, €50 per person. For cancellations of other products or in package holiday files, the cancellation handling fee will be €15 per booking. These handling fees will apply from the moment the booking is confirmed and the administrative processing of the file has begun.

**7.- Reissues and complementary services (where applicable)**   
If tickets are reissued or extra services with an issuance fee from the provider are sold (like seat selection, extra baggage, or others), that fee will be covered by the traveler and, due to its nature, won't be refunded once the process is complete.

**8.- Travel insurance (assistance and/or cancellation)**   
Before confirming, the traveler will be offered the option to get travel insurance. The traveler can choose to buy it or explicitly decline it. The insurance coverage, limits, and exclusions will depend on the policy purchased.

**9.- How to request changes or cancellations**   
To process changes or cancellations, the traveler must reach out to Chispa Mágica in writing, including the quote or file number, to keep a record of the request date and time. Any change or cancellation will only go through once the provider or organizer confirms it.

#### Pre-contractual package travel information (if applicable)

**1.- Application**

When the booked product legally qualifies as a "package travel", before the traveler is bound by the contract or a binding offer, the pre-contractual information required by current regulations will be provided, normally through the quote/itinerary and a summary of conditions on a durable medium.

**2.- Minimum content**

Generally speaking, that info will include, when it applies to your specific trip, the main details of the travel services included (destinations, itinerary, travel dates and times, transport, accommodation and its star rating, meals, tours or activities), the total price and breakdown of relevant costs, payment schedule, minimum group size (if applicable), passport/visa requirements and health info where needed, transfer conditions, cancellation policies for both the traveler and the organizer, plus details on how to handle complaints and dispute resolution.

**3.- Cancellation and unavoidable, extraordinary circumstances**

For package holidays, the traveler can cancel the contract before it starts, as allowed by the rules. If unavoidable and extraordinary things happen at or near the destination that seriously mess up the trip or getting there, the traveler can cancel without any penalty under the law. Handling cancellations, refunds, other options, and everything else follows the current rules and the paperwork given for that specific trip.

**4.- Protection against bankruptcy**

For package holidays, you'll get info about the organizer/retailer's protection against bankruptcy (and getting you back home if needed), plus all the details you need to use it based on the rules and the specific trip.

#### Complaints and Dispute Resolution

**1.- Customer service and internal complaints**

For any issue, question, or complaint, the user can contact LUXE ITINERA S.L. through the channels indicated on the Website, especially via email at [email protected] and by phone. For notification purposes, the contact postal address is Glorieta de los Países Bálticos nº 3, Córdoba (Spain). It is recommended that the complaint include the quote/booking number, dates, and a clear description of the reason, attaching documentation if available. An effort will be made to respond within a reasonable timeframe and, where appropriate, forward the issue to the corresponding supplier or organizer.

**2.- Complaint and grievance forms**

Official complaint and claim forms from the Regional Government of Andalusia are available to consumers and users, in accordance with Decree 472/2019, of May 28, and their administrative processing. Users can request them through the contact channels indicated in the previous section, and they will be provided under the legally established terms.

**3.- Consumer Arbitration System and ADR**

As of the publication date of this text, LUXE ITINERA S.L. is not generally affiliated with the Consumer Arbitration System or any specific alternative dispute resolution (ADR) entity. In the event of an unresolved complaint, consumers can turn to public consumer protection agencies and the appropriate administrative and judicial channels. If there is a legal obligation to use a specific ADR entity for a particular service, or if its use is explicitly agreed upon, this will be communicated in the terms applicable to that service, as required by current regulations.

**4.- Jurisdiction**

In the event of a dispute that cannot be resolved amicably, the parties may resort to the Courts and Tribunals with jurisdiction under applicable regulations, especially when the user legally qualifies as a consumer.

#### Commitment to Data Protection

(hereinafter, the data controller) assumes full responsibility and commitment to the establishment, implementation, and maintenance of this Data Protection Policy, ensuring the continuous improvement of the data controller with the aim of achieving excellence regarding compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJEU L 119/1, 04-05-2016), and Spanish personal data protection regulations, in particular Organic Law 3/2018 of 5 December on the Protection of Personal Data and guarantee of digital rights (LOPDGDD), as well as any specific sector-specific regulations that may apply and their implementing rules.

The LUXE ITINERA S.L. Data Protection Policy is based on the principle of accountability, according to which the data controller is responsible for compliance with the regulatory and jurisprudential framework governing said Policy and is able to demonstrate this before the competent supervisory authorities.

In this sense, the data controller will be guided by the following principles, which must serve all its staff as a guide and reference framework in the processing of personal data:

**1.- Data protection by design**

The data controller shall implement, both at the time of the determination of the means for processing and at the time of the processing itself, appropriate technical and organizational measures, such as pseudonymization, designed to effectively implement data protection principles, such as data minimization, and to integrate the necessary safeguards into the processing.

**2.- Data protection by default**

The data controller will put in place proper tech and organizational measures to make sure that, by default, only the personal info needed for each specific processing goal gets used.

**3.- Data protection across the info lifecycle**

Measures protecting personal info will apply all through the entire info lifecycle.

**4.- Lawfulness, fairness, and transparency**

Personal info will be handled lawfully, fairly, and transparently regarding the individual.

**5.- Purpose limitation**

Personal info will be collected for specific, clear, and legitimate goals, and won't be used later in a way that doesn't match those goals.

**6.- Data minimization**

Personal info will be adequate, relevant, and limited to what's necessary for the goals it's processed for.

**7.- Accuracy**

Personal data must be accurate and, where necessary, kept up to date; every reasonable step must be taken to ensure that personal data that are inaccurate, having regard to the purposes for which they are processed, are erased or rectified without delay.

**8.- Storage limitation**

Personal data must be kept in a form which permits identification of data subjects for longer than is necessary for the purposes for which the personal data are processed.

**9.- Integrity and confidentiality**

Personal data must be processed in a manner that ensures appropriate security of the personal data, including protection against unauthorized or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organizational measures.

**10.- Information and training**

One of the keys to ensuring personal data protection is the training and information provided to the staff involved in processing it. Throughout the information lifecycle, all personnel with access to the data will be properly trained and informed about their obligations regarding compliance with data protection regulations.

The Data Protection Policy of LUXE ITINERA S.L. is communicated to all staff of the data controller and made available to all interested parties.

As a result, this Data Protection Policy applies to all staff of the data controller, who must know and embrace it as their own. Each team member is responsible for applying it and checking the data protection rules that apply to their work, as well as spotting and sharing any ways to improve things so we can hit peak compliance.

Management or the Governing Body of LUXE ITINERA S.L. will review this Policy as often as needed to keep it up to date with current personal data protection laws, as well as the guidelines and tips from the relevant regulatory authorities.
